1. How should India balance the independence of the Election Commission with judicial accountability?
Answer: The Election Commission needs operational independence because elections should not be controlled by the government of the day. But independence cannot mean absence of accountability. Article 324 gives the ECI constitutional authority, while courts can examine whether its actions comply with law and constitutional principles. The Supreme Court has clarified that it did not approve modifications to Form 6 and has sought the relevant record. Recent reporting confirms this clarification. The correct balance is institutional autonomy with transparency, collective decision-making, due process and judicial review—not judicial control over routine election administration.
