1. Supreme Court on Delhi Protests — Constitutional Rights and Public Order
The Supreme Court held a special sitting on 11 October amid protests in Delhi demanding the resignation of Chief Election Commissioner Gyanesh Kumar. A Bench of Justices Joymalya Bagchi and V. Mohana directed authorities to prevent unlawful detentions, permit public movement and restore normal Metro, railway and internet services, subject to lawful public-order restrictions. It also issued notices to the Centre, Delhi Police and DMRC after finding a prima facie case for contempt proceedings. The underlying constitutional issue concerns Articles 19 and 21, which protect peaceful assembly, movement and personal liberty. Restrictions must have a lawful basis and meet standards of necessity and proportionality. The Court recognised the administration's responsibility to maintain public order without permitting arbitrary interference with civil liberties. Gist: Constitutional democracy requires both effective policing and judicial protection of fundamental rights. Allegations of excessive force and unlawful detention must be examined through due process.
