1. Supreme Court Raises the Bar on Re-arrest — Article 22 and Personal Liberty
The Supreme Court has strengthened constitutional safeguards against arbitrary arrest, holding that a person released because the police failed to communicate the grounds of arrest cannot simply be re-arrested at the discretion of the same authority. Article 22(1) guarantees that an arrested person must be informed of the grounds of arrest and be allowed legal representation. For re-arrest, written grounds must first be supplied and police must approach a magistrate, explaining both the earlier failure and the necessity of fresh arrest. The investigation should be transferred to another officer and a departmental inquiry initiated into the original violation. The Court stressed that these protections apply irrespective of the seriousness of the alleged offence. It also directed High Courts to award suitable mandatory compensation where procedural safeguards are violated. Logic and gist: criminal investigation is necessary, but constitutional procedure is itself a substantive protection of liberty; state power cannot cure an unconstitutional arrest merely through another arrest.
