1. Election Commission Appointment Law — Independence of the ECI
The Supreme Court considered petitions challenging the Chief Election Commissioner and Other Election Commissioners Act, 2023, which removed the Chief Justice of India from the selection committee for Election Commissioners. A two-judge Bench differed on whether the challenge itself required consideration by a Constitution Bench, but agreed to place the matter before the CJI. The controversy originates in the Anoop Baranwal judgment (2023), where the Court created an interim selection committee comprising the Prime Minister, Leader of Opposition and CJI until Parliament enacted a law. Parliament subsequently replaced the CJI with a Union Cabinet Minister nominated by the Prime Minister. Justice Dipankar Datta raised concerns over whether this leaves the Opposition member with meaningful influence, while Justice Satish Chandra Sharma considered the constitutional validity question sufficiently novel for a larger Bench. Logic and gist: Article 324 gives Parliament legislative authority, but institutional independence, neutrality and public perception of impartiality remain central constitutional concerns.
