1. FCRA Amendment Bill: Government Signals Retreat on Retrospective Asset Provisions
The Union Government reached out to the Opposition and indicated that the proposed Foreign Contribution (Regulation) Amendment Bill, 2026 would not contain penalising retrospective provisions, responding to anxieties raised by civil-society and religious organisations. The disputed framework concerned assets created from foreign contributions when an organisation's FCRA registration expires, is surrendered or cancelled. Critics feared that schools, hospitals and community institutions created years earlier could ultimately vest in a government-designated authority. The government clarified that the objective is continuity of management during interruptions in registration and that assets could be returned if registration is restored. The political outreach also reflects an attempt to break the parliamentary deadlock. The logic is to balance legitimate state oversight of foreign funding with the associational, religious and institutional autonomy of organisations. The gist is that national-security regulation must be prospective, proportionate and legally predictable, because vague retrospective powers can generate uncertainty and weaken trust between the state and civil society.
