1. मतदाता सूची से नाम हटाने में कानूनी सुरक्षा जरूरी: जस्टिस उज्जल भुइयां
सुप्रीम कोर्ट के जस्टिस उज्जल भुइयां ने मतदाता सूची से नाम हटाने की प्रक्रिया में उचित कानूनी सुरक्षा को अत्यंत महत्वपूर्ण बताया। उन्होंने लाल बाबू हुसैन बनाम Electoral Registration Officer मामले का उल्लेख करते हुए कहा कि मृत मतदाता को छोड़कर किसी व्यक्ति का नाम नोटिस और सुनवाई का उचित अवसर दिए बिना मतदाता सूची से नहीं हटाया जा सकता। उनका कहना था कि संविधान नागरिकों को ऐसे दो वर्गों में नहीं बांटता जिनमें एक के पास मतदान का अधिकार हो और दूसरे के पास नहीं। यदि कोई प्रक्रिया बड़ी संख्या में नागरिकों को मताधिकार से वंचित करती है तो उसकी वैधानिकता और निष्पक्षता गंभीर जांच का विषय बनती है। उन्होंने मताधिकार को नागरिकता की आत्मा से जोड़ा। तर्क और सार: electoral roll की शुद्धता आवश्यक है, लेकिन प्रक्रिया में natural justice, notice, hearing और transparency भी उतने ही जरूरी हैं। लोकतांत्रिक भागीदारी की विश्वसनीयता निष्पक्ष मतदाता सूची पर निर्भर करती है।
